What we accept

Request Type

What we need

Patient authorization

A HIPAA-compliant authorization signed by the patient or personal representative, naming the records, the recipient, and an expiration.

Subpoena

The subpoena plus satisfactory assurance under 45 CFR § 164.512(e): notice to the patient, or a qualified protective order.

Court order

The signed order. We produce only what the order describes.

Estate matters

Letters testamentary or of administration, or the documentation your state requires for a deceased patient's personal representative.

How a legal request is handled

1. Intake. You submit the form with the request type, practice name, and return date. We confirm what we need within one business day.

2. Review. We check the authorization or process against HIPAA and state law, including the extra protections for psychotherapy notes, substance use treatment, and HIV-related information.

3. Production. The records go out by secure electronic delivery or mail, Bates-numbered on request, with a certification of authenticity.

4. Documentation. Every release is logged as a disclosure so the patient's accounting is accurate.

Return dates. Put the deadline in the notes field. Requests with a court date are prioritized on intake.

FAQ

Questions we hear most

What do you need to release records to an attorney?

A HIPAA-compliant authorization signed by the patient or personal representative, or valid legal process: a subpoena with the required notice or protective order, or a court order. We tell you on intake exactly which one applies.

How quickly can you respond to a subpoena?

Standard turnaround is 10 business days from a complete request. Tell us the return date and we prioritize it. We also provide a custodian's affidavit or certification of records when the case requires one.

Can you certify the records?

Yes. We provide a certification of authenticity or a custodian's affidavit with the production, and a records custodian can testify to chain of custody if a court requires it.

Do you work with records retrieval services?

Yes. Retrieval services submit the same way as a law firm, with the client's authorization or the legal process attached.
